General Power of Attorney Property Delhi

A General Power of Attorney property Delhi agreement is a document that gives the owner or the main individual the authority to grant the other individual, known as the attorney holder, the power to do certain actions on their behalf. Under the conditions of the agreement, the attorney can be granted permission to appear in front of the Sub-Registrar, sign the documents, deal with the property or take a conveyance for the owner.

But, the attorney’s GPAs do not make the attorney the owner of the property. The Delhi Revenue Department clearly says that Power of Attorney cannot be treated as a title deed since it does not involve the transfer of property.

Can GPA be used in property sale?

For the question of “GPA valid for property sale” an important distinction is needed. Where there is a valid GPA, it can allow an agent to act as the owner’s agent, provided that the authority of the GPA is adequate and the legal requirements are fulfilled, by executing a sale deed for the owner. It is not a deed in itself that conveys ownership to the buyer.

The Delhi Revenue Department has explicitly given recognition to agents who present documents with a proper power of attorney obtained through a qualifying power of attorney issued under Sections 32 and 33 of Registration Act, 1908.

GPA vs. Sale Deed in Delhi

GPA vs. Sale deed Delhi is the basic difference between both. The main difference between the two documents is that a GPA gives the principal authority to act, while a registered sale deed is an instrument through which the ownership is transferred during a sale transaction.

So, a mere GPA from a property owner does not necessarily result in the GPA holder becoming the owner. A purchaser interested in acquiring title should consider the registered conveyance and chain of title, and not just a GPA.

Property Ownership through GPA

It is not the same with regard to property ownership under GPA as it is in the case of a registered sale deed. The holder of a GPA may have authority to act on the property or to sign documents, but it is still based on the principal.

The Supreme Court’s Law is that an agreement to sell or GPA transaction (where applicable) does not confer a title to immovable property without proper stamping and registration of a conveyance.

Power of Attorney for Property Registration

A power of attorney for property registration may be allowed to be presented before the Sub-Registrar and may be used to complete the registration formalities for the principal as long as the power fulfills the stipulations of the Registration Act.

Section 32 of the Registration Act allows for presentation by an agent acting on behalf of a validly granted power of attorney and Section 33 outlines the types of power of attorney accepted for this purpose.
